Article 1 – General
These Terms and Conditions apply to all offers made by LAHAA, all orders placed through the LAHAA online store and all agreements entered into between LAHAA and the consumer.
By placing an order through our online store, the consumer agrees to these Terms and Conditions.
Any deviation from these Terms and Conditions is only valid if agreed upon in writing between LAHAA and the consumer.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
Article 2 – Offers and Prices
All offers and prices displayed on the LAHAA online store are subject to change and may be modified at any time.
All prices displayed on the website include VAT, unless stated otherwise. Any applicable shipping costs will be clearly displayed before the order is completed.
LAHAA takes reasonable care to ensure that product information, prices and other information displayed on the website are accurate. In the event of an obvious error or mistake, LAHAA reserves the right to correct the information and, where necessary, contact the customer regarding the order.
Promotional offers, discount codes and other promotions are subject to the conditions stated with the relevant promotion and cannot be applied retrospectively unless explicitly stated otherwise.
Article 3 – Agreement
An agreement between LAHAA and the consumer is concluded once the consumer has successfully completed the ordering process and the order has been accepted by LAHAA.
After placing an order, the consumer will receive an order confirmation by email.
LAHAA reserves the right to refuse or cancel an order where there is a legitimate reason to do so, for example in the event of an obvious pricing error, suspected fraud or when a product is unexpectedly unavailable. If payment has already been made, the amount paid for the cancelled order will be refunded.
Article 4 – Orders and Payment
Orders can be placed through the LAHAA online store using the payment methods offered during checkout.
The consumer is responsible for providing complete and accurate information when placing an order.
Payment must be completed using one of the payment methods available at checkout. The availability of individual payment methods may vary depending on the consumer’s location and order.
Where a payment provider, such as Klarna, is used, additional terms and conditions of that payment provider may apply.
Prices, shipping costs and any applicable discounts will be shown before the consumer completes the order.
Article 5 – Delivery
LAHAA will process and ship orders with due care and as quickly as reasonably possible.
Delivery times stated on the website are indicative and may be affected by circumstances beyond LAHAA’s reasonable control.
Once an order has been shipped, the consumer will receive a Track & Trace code by email, where available.
The consumer is responsible for providing a complete and correct delivery address. If an order cannot be delivered due to incorrect or incomplete information provided by the consumer, any reasonable additional shipping costs may be charged to the consumer.
Applicable shipping costs will be displayed during checkout before the order is completed.
Article 6 – Right of Withdrawal and Returns
Consumers have the right to withdraw from their purchase within 14 days after receiving the order, without giving a reason.
To exercise the right of withdrawal, the consumer must inform LAHAA of the decision to withdraw within this 14-day period. After notifying LAHAA of the withdrawal, the consumer must return the products within 14 days.
The direct costs of returning the products are borne by the consumer.
During the withdrawal period, the consumer may inspect and try on the product only to the extent necessary to determine its nature, characteristics and fit. The consumer may be held liable for any reduction in value resulting from handling the product beyond what is necessary for this purpose.
Returned products should, where reasonably possible, be returned with their original tags and packaging.
Returns can be registered through the return process provided on the LAHAA website.
Article 7 – Refunds
After a valid withdrawal, LAHAA will process the refund in accordance with applicable consumer law.
LAHAA may withhold the refund until the returned products have been received or until the consumer has provided sufficient proof that the products have been returned, whichever occurs first.
Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed with the consumer.
LAHAA may deduct any reduction in value for which the consumer is responsible as described in Article 6.
The direct costs of returning products remain the responsibility of the consumer.
Article 8 – Legal Guarantee
Consumers are entitled to the statutory legal guarantee in accordance with applicable consumer law. This means that products must meet the standards that consumers may reasonably expect from them.
Article 9 – Complaints
Complaints regarding an order, product or service should be submitted to LAHAA as soon as reasonably possible after the consumer has discovered the issue.
Complaints can be submitted via the contact details provided on the LAHAA website.
LAHAA will review complaints with due care and will aim to provide a response within 14 days. If more time is required to investigate a complaint, the consumer will be informed accordingly.
Submitting a complaint does not affect any statutory rights the consumer may have under applicable consumer law.
Article 10 – Force Majeure
LAHAA will not be liable for delays or failure to perform its obligations where this is caused by circumstances beyond its reasonable control.
Such circumstances may include, but are not limited to, disruptions or delays affecting carriers, suppliers or other third parties, strikes, government measures, natural disasters, technical failures or other unforeseen circumstances beyond LAHAA’s reasonable control.
Where a force majeure situation occurs, LAHAA will take reasonable steps to limit its impact and fulfil its obligations as soon as reasonably possible.
Nothing in this Article limits any mandatory rights the consumer has under applicable consumer law.
Article 11 – Liability
LAHAA is liable in accordance with applicable law.
LAHAA is not liable for damage resulting from improper use of a product, failure to follow applicable care instructions, or incorrect information provided by the consumer, insofar as permitted by law.
LAHAA is not liable for indirect or consequential damages insofar as such liability may legally be excluded.
Nothing in these Terms and Conditions excludes or limits LAHAA’s liability where such exclusion or limitation is not permitted under applicable consumer law.
Article 12 – Intellectual Property
All content on the LAHAA website, including but not limited to texts, photographs, images, designs, logos, graphics and other materials, is owned by or licensed to LAHAA and is protected by applicable intellectual property laws.
The content of the LAHAA website may not be copied, reproduced, distributed, published, modified or otherwise used for commercial purposes without prior written permission from LAHAA, except where permitted by law.
Nothing in these Terms and Conditions grants the consumer any intellectual property rights belonging to LAHAA or its licensors.
Article 13 – Privacy
LAHAA processes personal data in accordance with applicable data protection laws and its Privacy Policy.
Information about how LAHAA collects, uses and protects personal data can be found in the Privacy Policy available on the LAHAA website.
Article 14 – Applicable Law and Consumer Rights
These Terms and Conditions and agreements between LAHAA and the consumer are governed by Dutch law.
This choice of law does not deprive consumers residing in another country of any mandatory consumer protection afforded to them under the laws of their country of residence where such protection applies.
Any disputes will be submitted to the competent court in accordance with applicable law.
Nothing in these Terms and Conditions limits or excludes any mandatory rights granted to consumers under applicable consumer law.
